ELIGIBILITY:The Salvatore Ferragamo “Walk in Lady Sarah Ashley’s Shoes” sweepstakes (the "Sweepstakes") is open only to legal residents of the United States who are eighteen (18) years of age or older at the time of entry. Employees of Ferragamo (USA), Inc., Neiman Marcus Group, Orion Expedition Cruises, Virtuoso, Tourism Australia, Twentieth Century Fox Film Corporation or other companies associated with the promotion of the Sweepstakes, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Sweepstakes is subject to federal, state, and local laws and regulations and is void where prohibited.
SPONSOR: The Sweepstakes is sponsored by Ferragamo (USA), Inc., 663 Fifth Avenue, New York, NY 10022 (the “Sponsor”).
AGREEMENT TO OFFICIAL RULES: Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
ENTRY PERIOD: The Sweepstakes begins on November 10, 2008 and ends at 11:59 p.m. Central Time on December 15, 2008 (the “Entry Period”). Entries submitted prior to or after the Entry Period will be disqualified.
HOW TO ENTER: Visit www.ferragamo.neimanmarcus.com and complete the online entry form. Any entries attempted through the use of agencies or robotic, repetitive, automatic, programmed, or similar methods will be void.
DRAWING: On or about December 17, 2008, the Sponsor will select one (1) potential winner in a random drawing of all entries received. The odds of being selected depend on the number of eligible entries. The potential winner will be notified via e-mail.
POTENTIAL WINNER REQUIREMENTS: Except where prohibited, the potential winner shall be required to complete, sign have notarized and return an affidavit of eligibility and liability/publicity release (the “Affidavit/Release”) within seven (7) days of notification. If a potential winner fails to return the Affidavit/Release within the required time period, an alternate entrant may be selected in his/her place in a random drawing of all entries received. Winner's travel companion must also complete, sign, have notarized and return an Affidavit/Release that must be received by Sponsor before claiming/participating in prize.
PRIZE: One (1) winner will receive two (2) round-trip, business-class tickets from Los Angeles LAX airport, San Francisco SFO airport or New York JFK airport to an Australian Gateway city and onwards to Darwin or Broome. Travel is subject to schedule changes and may only be used on Qantas Airways’ operated services. Travel to Los Angeles LAX airport, San Francisco SFO airport or New York JFK airport is not included in the prize and is the responsibility of the winner and his/her travel companion. Value of Airfare estimated at $20,000. Tickets are non-refundable and non-transferable. Prizes may not be sold to, bartered with, purchased or utilized by a third party. Winner will also receive one (1) junior suite for max two (2) passengers aboard Orion Expedition Cruises. Cruise is valid for 2009 Kimberley Season only (May-August) and is based on availability at time of booking. Cruise is non-transferable or exchangeable and cannot be redeemed for cash. Prize winners and their companions must travel on the same itinerary. Itineraries are subject to tides and weather and may be changed without notice. The winner will be required to agree to Orion’s Passage Terms and Conditions which can be found at HYPERLINK "http://www.orionexpeditions.com" www.orionexpeditions.com. Prize includes all meals and room service on board, entertainment and education programs, use of ship’s sporting equipment and facilities, all government fees and taxes, port and handling charges and fuel surcharge. Prize does not include pre/post accommodation, ground transfers to and from Orion, laundry, travel and medical insurance, bar expenses, optional shore experiences, medical treatment, telephone and internet charges, items of a personal nature and hair and massage treatments. Winner will be provided with a formal letter of confirmation for booking purposes. Winner is required to have a current passport valid for at least six months from sailing date. Cruise currently valued at $15,721.00. Orion Expedition Cruises accepts no responsibility for any variation in the value of the prize. Sponsor will not replace any lost or stolen tickets, travel vouchers or certificates. Once booked, no change, extension, or substitution of trip dates is permitted, except by Sponsors at their sole discretion. In the event that the winner is not available to schedule a trip before this date, the prize will be forfeited and the Sponsor may opt at its discretion to select an alternate winner in a random drawing of entries received. If repeated attempts to contact the winner to arrange for fulfillment of the prize are met with no response, the prize will be forfeited and the Sponsor has the right to select an alternate winner in a random drawing of entries received. The winner and his/her travel companion are each responsible for having all governmental travel documentation, passports and permissions required for any travel that they might undertake as a part of this Sweepstakes, and that if they do not have valid travel passports, permissions and/or documentation, the will not be able to travel and will forfeit the prize/trip. Winner will also receive one (1) pair of Ferragamo Lady Sarah shoes in red or black within size range of 5.5 to 10.5, b width. (Retail Value - $950.00). No customization or adjustments will be made to the shoe. Estimated total value of prizes ($46,700.00)
GENERAL CONDITIONS: In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the prizes at random from among the eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in a disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the participant. The “authorized account holder” is the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted e-mail address. Winner is solely responsible for any tax on the prizes awarded. Each winner will receive an IRS Form 1099 for the approximate retail value of the prizes, if applicable per IRS regulations.
RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Sweepstakes, entrants agree to release and hold harmless the Sponsor, Neiman Marcus Group, Twentieth Century Film Corporation their related companies, and their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorneys’ fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New York. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of New York, without giving effect to any choice of law or conflict of law rules (whether of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New York.
